Technical Track Work Group Meeting Follup: PCBs and Sediments in Spokane River- Ecology Studies

Per the discussion at the March 1, 2017 TTWG meeting, here is a list of references regarding PCBs and sediments in the Spokane River.  The newer studies contain a reference to where the data can be found on the EIM on the “Publication and Contact Information” at the beginning of the document.

There is an additional dataset of 8 Urban Waters samples that were collected in 2013 (sediment and seeps) which is in the final stages of upload to EIM. I will send the link to download that data when it is ready.

Ecology News: State Solid and Hazardous Waste Plan- Moving Washington Beyond Waste and Toxics

Here is a sample of work the Department of Ecology and our partners around the state have been doing to support the goals in the State Solid and Hazardous Waste Plan – Moving Washington Beyond Waste and Toxics:

o   Cascadia Consulting group, working with FCS and Abbe & Associates, is working on identifying potential sustainable funding mechanisms for components of Washington’s solid waste system. The process will include two surveys (the first has already been sent out to this Listserv), with a final report expected in June 2017.

o   The 2016 Statewide Waste Characterization Study is done, providing updated data from the last study, which was completed in 2009. The largest components in our waste stream, by weight, continue to be organics and paper. This study also provides a breakdown of products versus packaging, as well as edible (at the time of disposal) versus inedible food.

  • Northwest Region Commingled Recycling Report and Next Steps

(Supports Goal SWM 5, Actions 5A and 5B on page 27 in the Solid Waste and Materials section)

o   Ecology led a large, diverse and dedicated group of stakeholders who researched and wrote this informative report, titled Optimizing the Commingled Recycling System in Northwest Washington. The group is now starting to work on recommendations from the report. Three workgroups are being established:  1) Educational Messaging; 2) Contracting Harmonization; and 3) Packaging Industry Collaboration. Statewide participants are welcome and needed.

  • Greening State Contracts with Environmentally Preferred Purchasing (EPP)

(Supports Goal RIMP 2, Action RIMP 2A on page 34 in the Reducing Impacts of Materials and Products section)

o   Ecology and the Department of Enterprise Services are joining forces to prioritize and green more state purchasing contracts.  Currently, they are focusing on state contracts for Facilities Maintenance and Repair supplies, Bulk, Frozen and Canned Food, Compostable Food Serviceware, and Janitorial Chemicals.

o   The Polychlorinated Biphenyls in Consumer Products report was published in November 2016.  This study examined 201 common consumer items, such as paints and packaging, to look for the presence of byproduct PCBs. The study included products purchased under Department of Enterprise Services contracts. According to state law (RCW 39.26.280 and RCW 39.26.290), the state has a preference for purchasing non-PCB containing items.

o   A series of training videos on designating your waste are available on Ecology’s website.  An additional video on pharmaceuticals will be available in Spring 2017.  Many pharmaceuticals can be hazardous to people or the environment if they are thrown away or flushed down the drain.

  • Ecology is collaborating with University of Washington and others to provide training opportunities for identifying safer chemicals.
  • Transitioning to Safer Chemicals – in-person 1.5 day training (learn more)
  • List Translator: Introducing a Tool to Screen for Chemical Hazards – a 1.5 hour webinar to learn the basic principles of chemical hazard assessments, why they are of interest and simple tools to identify and screen out hazardous chemicals (learn more)

CSPA Reporting Rule Update

Happy holidays to everyone.
Please extend my thanks to the members of SRRTTF for the request for consideration of PCBs as an addition to the Chemicals of High Concern to Children during the Children’s Safe Products Act rulemaking update.  Ecology reviewed the information submitted.  At this time, PCBs are not being considered as an addition to the CHCC list.  The scope of the current rulemaking is too narrow to accommodate a rulemaking change to lower the 100 part per million reporting limit for chemicals present as contaminants.

Ecology Funding Opportunity: Watershed Planning Implementation and Flow Achievement Grants

Water Resources Program Funding Opportunity: Applications accepted from October 17th, 2016 – December 15th, 2016.

Funding under this program requires flow achievement, through:

  • Increased flows below the project site.
  • Improving instream and riparian zone conditions, such as enhancing fish passage or habitat.
  • Reorganizing or concentrating existing points of diversion.
  • Establishing water banks, water exchanges or pursing trust water opportunities.
  • Improving public water supply or irrigation district infrastructure that leads to water savings.
  • Purchasing and installing meters, stream gages or groundwater monitoring equipments when water savings and or efficiencies can be expected short or long term.

Ecology News: Rule-making Information for WAC 173-350 – Solid Waste Handling Standards [mailto:ECY-SW-HANDLING-STANDARDS

We wanted to update you on progress toward revising the rules in Chapter 173-350 WAC – Solid Waste Handling Standards.

Outcome of July Meetings

More than a hundred stakeholders attended three meetings across the state in July.  The purpose of the meetings was to inform stakeholders about possible changes, and why, and to generate discussion.  Participants raised good questions, and helped the agency identify aspects of the draft rule needing more consideration.  As a result, lead staff are already working on some changes to the draft rule.

Updated Web Site

There have been some important updates on our web pages.  If you need a refresher, or were unable to attend the meetings there is a way for you to learn more about the rule.  We have added video clips and pdfs of individual presentations from the Lacey meeting to our public involvement page.  You can choose your area of interest in order to make the best use of your time.

We have also posted a revised version of the draft rule to our documents page.  The new version reflects errors noted in the draft that were corrected following the meetings.  Errors to date are generally minor.  There were several corrections in new section 995 – Soil and sediment screening levels, which is used in conjunction with new section 235 – Soil and sediment criteria and use.  Some threshold levels and footnotes for chromium, lead, and molybdenum were corrected, and additional information was added in the reference portion following the criteria table.  These are detailed in the errata sheet included with the revised draft.  If you find any errors in the draft rule, please let us know.

Next Steps

We will be evaluating any comments we receive by early September.   We have asked for comments from stakeholders by September 6.  Ecology plans to move forward with drafting formal rule revisions this fall, and we hope to make a formal rule proposal later this year or early in 2017.  The formal proposal will include public hearings and an additional comment period before and after the hearings. We are continuing to work with stakeholders to improve rule language in the interim.
